Game of Whales Ltd. (“Game of Whales”, “we”, “our” or “us”) respects the privacy of the Developers of its Services and/or its Site (the “Developer” or you”) and is fully committed to protect the personal information that the Developer and its End Users share with it in connection with the use of the Site and/or Service.
Developer’s Consent (PLEASE READ CAREFULLY!)
1. Which information we may collect?
We may collect two types of data and information from you and your End Users:
For the avoidance of doubt, any Non-personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.
Personal and Non-personal Information which is being gathered on the Developer in connection with the Site and/or Service may consist of the following:
Developers who are interested in opening an Account in order to use our Services should provide a username and password and other details via the registration form of the Site (namely, name of company, company registration number, company address, authorized signatory name and title, e-mail, phone number, list of mobile applications to be used for the Service). In addition, we may collect Personal Information in order to charge the Developer for our Services. This information may include a credit card number and other billing information (see Section 7.2 of the Terms regarding the payment method).
Customers who are only visiting the Site do not need to provide any Personal Information other than their IP address and unique device identifiers.
In the event that a Customer subscribes for newsletters via the Site, such Customer will be required to provide its e-mail address.
As part of the operation of our Service you may provide us with data about your End-User’s use of your mobile application (the “End-User Data”), such as:
Non-personal Information regarding the End-Users: which consists of technical information and aggregated usage information, and may contain, among other things: (i) the End- User’s type and version of operation system or platform; (ii) data regarding the opening of the mobile application by the End User’s (iii) the End User’s usage length and duration; (iv) the End-User’s phone device model; (v) the End-User’s usage frequency; (vi) the End-User pre-defined events in the your mobile application; (vi) the End User’s time stamp; (viii) (x) the End-User’s in-app purchases; and (ix) any other actions the End-User performed during his/her use of your mobile application and cross application activities of the End User.
Our Services and the Game of Whales SDK will not collect any information about other programs that the End-Users are running on their mobile phone/computer. The Game of Whales SDK does not track the End-User's activity across applications that do not use the Services, and will not collect any passwords entered into the End-User's mobile phone/computer.
How Do We Collect Information?
There are three main methods we use to collect information:
We collect Non-personal Information through your use of the Site and/or Service. In other words, when you are using the Site and/or Service we are aware of it and may gather, collect and record certain information on you relating to such usage.
We collect Personal Information on Developers which you provide us voluntarily when you register to our Service via our Site and open an Account by completing the registration form. We store the Personal Information either independently or through the help of our authorized third-party service providers as detailed below.
We collect Non-personal and Personal Information on your End User’s automatically by the Game of Whales SDK from the activities and usage of the End User while using your mobile application.
4. What are the Purposes of the Collection of Information?
We collect Non-personal and Personal Information in order to provide, operate and improve the Site and the Services, including for statistical, analytics, segmentation, interactions with the end- users, research purposes, and other business and commercial purposes; to enable us to further develop, customize and improve the Site and/or Service based on common preferences, uses, attributes, functionality and feature choices; to create and provide our research and business partners with data and other aggregated, statistical and/or inferred Information; to enable us to provide our Developers with a better user experience, suggestions with more relevant and accurate information, services, features and functionality, and with technical assistance and support; and in order to abide by any applicable law.
Sharing Information with Third Parties
For avoidance of doubt, we may transfer and disclose to third parties or otherwise use Non- personal Information at its own discretion.
Privacy of End-User Data
In addition, an End-User who seeks to correct, amend inaccurate End-User Data or withdraw consent for further use of its End-User Data, the End User may reset his Advertiser ID and/or the entire history associated with such End User’s Advertiser ID or change its Do Not Track Settings on its mobile device. In addition, the End User may direct its query to the applicable Developer with whom he/she has a direct contact. If you requests us to remove such data we will respect your privacy choices and make reasonable efforts to do so, per section 7 below. 7. Modification or Deletion of Personal Information
If for any reason you wish to modify your Personal Information you can do so yourself on the Service via your Account or send us an email to: firstname.lastname@example.org If for any reason you wish to delete your or any End-User’s Personal Information you can send us an email to email@example.com We will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws.
Note that unless you instruct us otherwise we may retain your and your End Users’ Personal Information for a period for as long as reasonably needed to provide the Service and/or as legally required.
We take a great care in implementing and maintaining the security of the Site, the Service and the Developer’s and it’s End Users’ Personal Information. The Personal Information is hosted on third party hosting services, including without limitation, Amazon Web Services (USA), Hetzner (Germany) and Leasweb (NL) and others which provides advanced security features. Game of Whales employs industry standard procedures to ensure the safety of it’s the Personal Information, and prevent unauthorized use of any such information (such as Firewall). However, we do not and cannot guarantee that unauthorized access will never occur.
